The Offer in Compromise program was established to grant relief, in certain situations, to people assessed with a tax. It is an agreement between a taxpayer and the IRS that resolves the taxpayer’s debt by less than full payment. Such debt can be compromised for one of the following reasons:
 
  • Doubt as to liability – There is doubt the assessed tax is correct.
  • Doubt as to collectibility – There is doubt the taxpayer will be able to pay the debt in full.
  • Effective tax administration – There is no doubt as to liability or collectibility, but there are exceptional circumstances. The taxpayer must demonstrate collection of the debt would be unfair and inequitable or would create an economic hardship.
The Offer in Compromise is not the best option a taxpayer can get. It is important to determine if tax liability can be avoided at the audit, appeal or tax court level before beginning the payment option of an Offer in Compromise. Do not surrender your rights without a fight!
 
If you do qualify for the Offer in Compromise program, it is best to have an experienced and knowledgeable attorney to help you through the process. The chances of a successful petition are much better if you have an attorney on your side.

Television ads claim to settle your debt for “pennies on the dollar.” While these offers are attractive, these providers often fail to make settlement offers on a case-by-case basis and the IRS often rejects these offers. The IRS issued a consumer alert urging taxpayers to beware of these types of advertisements. The link to this alert can be found in the “Articles” area of our website.
