Divorce
Divorce is the legal process that dissolves a marriage. There are five reasons (called “grounds”) for divorce in South Carolina:
- Adultery
- Physical cruelty
- Habitual drunkenness or drug use
- Desertion of a period of one year or more
- Living separate and apart for one year or more (also called “no-fault”)
Every divorce case is different. If all parties agree on the issues involved, as in an uncontested divorce, the process can be fairly simple. On the other hand, a divorce can become complex if there is disagreement, large amounts of assets that need to be divided or if the couple has minor children.
In addition to signaling the end of your marriage, a divorce decree will divide the marital property and debt, award any alimony that is warranted, decide custody of the minor children and order any child support if necessary.
