Special Needs Planning


If you currently care for a child or loved one with special needs, such as mental or physical disabilities, you will most likely have concerns about what may happen to them when you are no longer able to care for them. While it is possible to provide for them through bequests of money and assets, doing so has the possibility to disqualify them from receiving benefits under the Supplemental Security Income (SSI) and Medicaid programs.
 
While SSI and Medicaid can supply money for the basic necessities, these limited benefits do nothing to ensure your loved one will have the resources to enjoy a richer quality of life. The government has established a certain type of trust, called a “Special Needs” or “Supplemental Needs,” that will allow assets to be held in trust for a recipient of SSI or Medicaid. A Special Needs Trust can stand alone or work in conjunction with your larger estate plan.
 
The Special Needs Trust can be used for a variety of life-enhancing expenditures without compromising your loved ones’ SSI or Medicaid eligibility, such as:
 
  • Annual check-ups at an independent medical facility
  • Attendance of religious services
  • Supplemental education and tutoring
  • Out-of-pocket medical and dental expenses
  • Transportation
  • Maintenance of vehicles
  • Hobbies
  • Recreational activities and entertainment
  • Trips or vacations
  • Home furnishings and electronics
  • Athletics
  • Special dietary needs
  • Personal care
  • Attendant or escort
